Purchaser – what we do for you

Every conveyance is different, however at a minimum our services include (but are not limited to) the below.

When we act for you as the Purchaser:

  • We will check over the Contract and Form 1 during the cooling off period
  • We will prepare and send out your Client Authorisation forms, including requesting contact details for your broker/banker if you are obtaining finance, and obtain relevant instructions from you regarding your transaction
  • We will complete your Verification of Identity (VOI) at our Blackwood office in the Adelaide Hills, or online
  • We will liaise with your broker or lender if you are obtaining finance for your purchase
  • We will ensure all parties to the transaction (ourselves, vendors conveyancer, discharging lender, incoming lender etc) have been invited into PEXA, and are working together towards settlement
  • We will order any necessary government and statutory searches to obtain current rates and taxes due on the property. We will check these against figures provided to us by the Vendors conveyancer to ensure no discrepancies
  • We will ensure any conditions within the Contract are satisfied by the due dates
  • We will prepare your settlement statement outlining all applicable costs, deposits, fees and charges relating to your purchase, including stamp duty and registration fees, the adjustment of rates and taxes, the loan amount available from your lender and any funds you are required to contribute
  • We will attend to settlement on your behalf, including certifying the transfer and lodgement with the Lands Titles Office via PEXA or in person as required
  • We will arrange payment of Stamp Duty to Revenue SA
  • We will notify you and the Real Estate Agent once settlement has been completed
  • Finally, once settlement is completed we will notify relevant parties of the change of ownership, including SA Water, Council, Revenue SA and strata/property managers if applicable.

We can help you from the beginning by preparing contract and Form 1 documents if required, or if your agent has already attended to these, we are here to work with you from contract signing through to settlement. Every conveyance is different, however at a minimum our services include (but are not limited to) the below. When we act for you as the Vendor:

  • We will either prepare the Contract and Form 1 documents or check over the Contract and Form 1 for you
  • We will prepare and send out your Client Authorisation forms, including your lenders Discharge of Mortgage form if applicable, and obtain relevant instructions from you regarding your transaction

  • We will calculate the adjustment of rates and taxes and advise the Purchasers representative
  • We will ensure any conditions within the Contract are satisfied by the due dates
  • We will prepare your settlement statement, which details all applicable costs, deposits, fees and charges relating to the sale, including any outstanding rates and taxes. It also details the amount payable to your lender to discharge your mortgage if applicable, and the balance due to you at settlement
  • We will attend to settlement on your behalf, including certifying the transfer and lodgement with the Lands Titles Office via PEXA or in person as required
  • We will notify you and the Real Estate Agent once settlement has been completed
  •  Finally, once settlement is completed we will notify relevant parties of the change of ownership, including SA Water, Council, Revenue SA and strata/property managers if applicable.

A Form 1 (also known as a Vendor’s Statement), is a statutory disclosure statement that must be served on a Purchaser once a sale contract has been signed. The Land and Business (Sale and Conveyancing) Act 1994 requires an accurate Form 1 statement to be provided to an incoming Purchaser, setting out cooling-off rights and specified particulars regarding the property.

The Vendor must legally disclose any information on the property which would negatively alter the value so that the transaction is transparent and the Purchaser knows exactly what they are buying, and it is imperative that the Form 1 is accurate at the time of serving.

The cooling off period begins once the Form 1 has been served on the Purchaser, and expires at the end of the second clear business day after the Form 1 has been served. The cooling off period is used by the Purchaser to complete their due diligence (building/pest inspections etc) with the option to withdraw from the Purchase for any reason during this period. *Please note – there is no cooling off period when you buy at auction.
